If mail is being passed to your server directly from a dynamic IP (ie,
internet users) then it can be guaranteed to be spam. No legitimate mail
server will use a dynamic IP address. Even if it's a static IP that's
used for DSL/Cable service, there will never be a legitimate mail server
running on this type of connection.

I don't know about 'guaranteed' - I've got a client that uses a mail server on his IP, so he can use MS exchange server. I've warned him about this, but he's willing to take his chances. even tho its dynamic, it hasn't changed in over a year for his setup.
